Service Liability Waiver

Terms and Conditions

I represent that I am the legal owner or agent for the owner of the dog I have booked into your services . I release Lucy in the sky with Barry's, its staff, owners, representatives, and agents from any and all liability which I or my dog may suffer including but not limited to escape, injury, sickness, damage or death resulting from participation in overnight boarding.

I understand and agree that I am solely responsible for any harm or damage caused by my dog while utilising the Services including any damage to local livestock. I agree to notify Lucy in the sky with Barry's of any and all alleged problems with the dog within twenty-four (24) hours of my dog’s use of the Services.

Overnight Safety of Dog

Lucy in the sky with Barry's will secure my dog overnight in the "Dog Room" that I was shown upon my "Meet and Greet" and will endeavour to allow my dog to choose their own sleeping location. I understand that my dog will be unsupervised overnight during sleeping hours and will be in the company of other guest dogs.

Should my dog display unsuitable behaviours such as property destruction or be deemed a danger to themselves or other dogs overnight, I agree that my dog may be secured in a crate that is suitable for their breed and size should it be deemed necessary by Lucy in the sky with Barry's. 

Health of Dog

I represent that my dog is in good health, is currently on all required vaccinations (DHP, KC, L4), is free of fleas, ticks, and lice, and has not been ill with any known contagious viruses in the last 30 days.

I understand that any lapse in my dog's vaccines will result in a risk that my dog may contract a contagious disease or illness. I agree that should this occur I am responsible for my own pet’s care and medical attention. I agree that my dog does not have any condition that could potentially jeopardise the health of other dogs and/or people.

I understand that although all dogs are fully supervised, incidents of injuries may occur from playing with the other dogs or from the garden debris, which include but are not limited to bites, scrapes, scratches, and sprains.

Behaviour of Dog

I represent that to the best of my knowledge, my dog has good general behaviour in order to attend overnight boarding with other dogs they may not have met.

I agree my dog does not have a history of showing aggression or exhibiting threatening behaviour to any person or other dogs, this includes any and all resource guarding. My dog does not have a history of opening doors, enclosures, escaping the home or jumping a property boundary line. My dog does not display a strong interest, aggression or arousal for livestock. 

I agree that any behaviour that may fall into any above category has been fully disclosed to Lucy in the sky with Barry's before booking.

Dog meals and snacks

I agree my dog will not be given any food or treats that have not been provided by me. I agree to provide the correct amount of food for my dog in relation to the length of their stay. Should the food that I provide not be sufficient for the length of stay, Lucy in the sky with Barry's will contact me and provide notice my dog will be fed a generic kibble of their choosing. 

In the event that my dog has to be fed by Lucy in the sky with Barry's, I release Lucy in the sky with Barry's, its staff, owners, representatives, and agents from any and all liability which my dog may suffer including but not limited to injury, sickness, damage or death resulting from feeding.

I agree that should this occur I am responsible for my own pet’s care and medical attention.

Emergencies

In the event of an emergency Lucy in the sky with Barry's will contact me and my given emergency contact, in the event I can not be reached, Lucy in the sky with Barry's is authorised to seek veterinary assistance in a vet of their choosing and make urgent medical decisions needed.

I assume full responsibility for any and all charges incurred therewith, including but not limited to diagnosis, treatment, grooming, medical supplies and boarding.

Collections

In the event that I or my designated persons do not collect my dog on the agreed upon departure date, I hereby authorise Lucy in the sky with Barry's to continue to provide boarding and any additional expense will be incurred by me. If I am late for collection I agree to pay a 10EURO late fee and an additional 10EURO per hour thereafter. 

Abandoned Dog Procedure 

I understand that if my dog is not collected, Lucy in the sky with Barry's will attempt to contact me by telephone and/or in writing using the information that has been provided, advising me that if my dog is not picked up within 7 days, my dog will be deemed to be abandoned and they will deliver my dog to a third party adoption partner, animal shelter, or attempt to find a new owner for my dog. If I fail to pick-up my dog for any reason, I release Lucy in the sky with Barry's, its staff, owners, representatives, and agents from further liability and responsibility for my dog.

Personal Property

I understand that Lucy in the sky with Barry's is not liable for any lost, stolen or damaged personal property belonging either to me or to my dog including house keys. I further understand that if my dog causes any property damage I assume all responsibility for the full cost of all treatment, repairs and replacements.

Photos and Videos

Occasionally, photos or video footage may be taken of dogs utilising the Services. I agree to allow Lucy in the sky with Barry's to use any image, video or likeness of my dog taken while using the Services for marketing, educational or promotional materials, understanding that the resulting photos, videos or likenesses are the sole property of Lucy in the sky with Barry's

BY BOOKING THIS SERVICE I AGREE THE I HAVE READ THIS AGREEMENT IN ITS ENTIRETY AND UNDERSTAND THAT IT IS AN AGREEMENT TO INDEMNIFY LUCY IN THE SKY WITH BARRY'S AND IT IS A WAIVER AND RELEASE OF LIABILITY AND A PROMISE NOT TO SUE OR MAKE A CLAIM.  I AM AWARE THAT THIS AGREEMENT IS A CONTRACT BETWEEN LUCY IN THE SKY WITH BARRYS AND ME.
