What “Lucy in the sky with Barry’s” will provide

Lucy in the sky with Barry's here after being referred to as “LITSWB” agrees to care for my dog(s) in their own home to the best of their ability, providing adequate exercise and enrichment during their stay. LITSWB will follow my feeding and medication schedule to the best of their ability and provide supervision and human company to my dog during their stay. LITSWB will endeavour to ensure my dog's safety and happiness for the entirety of their stay.

During periods where my dog is unsupervised LITSWB will ensure my dog has been secured in a safe place and will endeavour to make these periods as infrequently as possible.

What I “The Customer” agrees to by booking 

I represent that I am the legal owner or agent for the owner of the dog I have booked into LITSWB services . I release LITSWB from any and all liability which my dog may suffer including but not limited to escape, injury, sickness, damage or death resulting from participation in overnight boarding.

I understand and agree that I am solely responsible for any harm or damage caused by my dog while utilising the services including any damage to local livestock. I agree to notify LITSWB of any and all alleged problems with the dog within twenty-four (24) hours of my dog’s use of the Services.

Supervision of Dog

LITSWB agrees to supervise my dog(s) to the best of their abilities; however, I understand that my dog will not have supervision 24 hours a day. 

During periods where my dog is unsupervised LITSWB will ensure my dog has been secured in a safe place and will endeavour to make these periods as infrequently as possible.

I also understand that while my dog will be in LITSWB home they will technically be unsupervised overnight during sleeping hours and will be in the company of other guest dogs.

Behaviour of Dog

To the best of my knowledge, my dog has good general behaviour in order to attend overnight boarding with other dogs they may not have met.

I agree my dog does not have a history of showing aggression or exhibiting threatening behaviour to any person or other dogs, this includes any and all resource guarding. 

I agree my dog does not have a history of opening doors, enclosures, escaping the home or jumping a property boundary line. My dog does not display a strong interest, aggression or arousal for livestock.

Should my dog display unsuitable behaviours such as property destruction or be deemed a danger to themselves or other dogs overnight, I agree that my dog may be secured in a crate that is suitable for their breed and size should it be deemed necessary by LITSWB.

I understand that should my dog display any signs of aggression to any person or other dogs that LITSWB will immediately terminate my booking and contact myself or my emergency contact to have my dog collected within 24 hours of being notified. Should my booking be terminated in this manner then I agree I will forfeit any refund for the remainder of the booking.

Emergencies

I agree that for every booking I will provide an up to date emergency contact and that the emergency contact will be available to collect my dog with a maximum of 24 hours notice during my dogs stay.

In the event of an emergency I understand that my emergency contact will be responsible for collecting my dog and bringing them to seek medical care. I agree that I have explained this to my emergency contact in detail and have acquired their consent to use them as my emergency contact.

In the event my emergency contact can not be reached, LITSWB is authorised to seek veterinary assistance in a vet of their choosing and make urgent medical decisions needed including euthanasia where medically advised.

I assume full responsibility for any and all charges incurred therewith, including but not limited to diagnosis, treatment, grooming, medical supplies and boarding. 

I understand that incidents or injuries may occur from playing with the other dogs or from the garden debris, which include but are not limited to bites, scrapes, scratches, and sprains.

Cancellation Policy

LITSWB will notify me as soon as possible to let me know if they need to cancel my booking. In such an event that the booking is cancelled by LITSWB, I will be entitled to a full refund. Any refund given will be paid back to the card that it was booked online with, I understand that standard banking transaction times will also apply here.

I agree that in such an event that the booking is cancelled by myself , I will no longer be entitled to a refund.

I agree that if my dog is near the end of its life or has been advised by the vet to be euthanized that they are no longer suitable for boarding of any kind and I will notify LITSWB so they can cancel the booking on my behalf and provide a full refund.

Health of Dog

I represent that my dog is in good health, is currently on all required vaccinations (DHP, KC, L4), is free of fleas, ticks, and lice, and has not been ill with any known contagious viruses in the last 30 days.

I understand that any lapse in my dog's vaccines will result in a risk that my dog may contract a contagious disease or illness. I agree that should this occur I am responsible for my own pet’s care and medical attention. I agree that my dog does not have any condition that could potentially jeopardise the health of other dogs and/or people.

I understand that it is common for an elderly or sick dog to suffer from separation more severely and boarding my dog may exacerbate their pre-existing symptoms resulting in a more rapid deterioration upon their return home. 

Dog meals

I agree to provide the correct amount of food for my dog in relation to the length of their stay. Should the food that I provide not be sufficient for the length of stay, LITSWB will contact me and provide notice that my dog will be fed a generic kibble of their choosing.

In the event that my dog has to be fed by LITSWB, I release LITSWB from any and all liability which my dog may suffer including but not limited to injury, sickness, damage or death resulting from feeding. I agree that should this occur I am responsible for my own pet’s care and medical attention.

Abandoned Dog Procedure

I understand that if my dog is not collected, LITSWB will attempt to contact me by telephone and/or in writing using the information that has been provided, advising me that if my dog is not picked up within 7 days, my dog will be deemed to be abandoned and they will deliver my dog to a third party adoption partner, animal shelter, or attempt to find a new owner for my dog. If I fail to pick-up my dog for any reason, I release LITSWB, its staff, owners, representatives, and agents from further liability and responsibility for my dog.

Personal Property

I understand that LITSWB is not liable for any lost, stolen or damaged personal property belonging either to me or to my dog including house keys. I further understand that if my dog causes any property damage I assume all responsibility for the full cost of all treatment, repairs and replacements.

Photos and Videos

Occasionally, photos or video footage may be taken of dogs utilising the Services. I agree to allow LITSWB to use any image, video or likeness of my dog taken while using the services for marketing, educational or promotional materials, understanding that the resulting photos, videos or likenesses are the sole property of LITSWB and can be used even after my dog has passed away.

BY BOOKING THIS SERVICE I AGREE THE I HAVE READ THIS AGREEMENT IN ITS ENTIRETY AND UNDERSTAND THAT IT IS AN AGREEMENT TO INDEMNIFY LUCY IN THE SKY WITH BARRY'S AND IT IS A WAIVER AND RELEASE OF LIABILITY AND A PROMISE NOT TO SUE OR MAKE A CLAIM. I AM AWARE THAT THIS AGREEMENT IS A CONTRACT BETWEEN LUCY IN THE SKY WITH BARRY’S AND ME AND THAT I AM NOT COVERED BY STANDARD CONSUMER RULES AS I HAVE ENTERED INTO THIS CONTRACT.
